Chapter 1 General Provisions

Article 1 (Definitions)

The terms used in these Terms shall have the following meanings:

・Attachment control panel: Key control device installed in the shared bicycle
・Cycle sharing system: A system that lends shared bicycles to members by entering and exiting the port during service operation hours
・Shared bicycles: Bicycles for shared use provided by the Corporation (as defined in Article 2)
・Port: Rent, return and storage of shared bicycles
・Individual member: A person who has entered into a membership contract for the cycle sharing system in accordance with Article 3 and uses the cycle sharing system.
・Corporate Member: A person who has entered into a membership agreement with the Corporation for the cycle sharing system in accordance with Article 3, and who has legal personality by law, such as a for-profit corporation such as a corporation, a non-profit corporation, and a public corporation.
・Members: A general term for individual members and corporate members
・Corporate Designated User: An individual who designates the Cycle Sharing System as the person who performs the member's own business when the corporate member concludes a membership contract.
・Users: A general term for individual members and corporate designated users
・Authentication card: A general term for dedicated IC cards prescribed by the Corporation, transportation IC cards, mobile wallets registered in the system prescribed by the Corporation, etc., which are necessary for verifying the identity of members and unlocking shared bicycles.
・Osaifu-Keitai: A mobile phone with an embedded IC chip
・Secretariat: A base that maintains and manages shared bicycles and ports, and responds to members, and the contact information of the base is disclosed on the website of the corporation.
・Jurisdiction: Izumo City

Article 2 (Application of Terms)

Sanin Panasonic Co., Ltd. (hereinafter referred to as "the Corporation") has entered into an agreement (hereinafter referred to as the "Membership Agreement") with individuals or corporations who wish to join the Cycle Sharing System in accordance with the provisions of this Agreement (hereinafter referred to as the "Membership Agreement") at the Izumo City Public Bicycle Sharing System (hereinafter referred to as the "Project") operated by the Corporation. During the enrollment period, we will provide a service to lend a shared bicycle. Matters not stipulated in this agreement shall be subject to laws and regulations or general customs.
The Corporation shall be able to create a "User's Guide". In the event of any discrepancy between these Terms of Use and the applicable "User's Guide", the "User's Guide" shall prevail.
These Terms of Use shall apply to Members. In addition, the corporate member shall cause the corporate designated user to comply with the contents of this agreement, and the corporate member shall be jointly and severally responsible for all acts related to the use of the cycle sharing system, regardless of the act or omission such as violation of this agreement by the corporate designated user.

Chapter 2 Enrollment Agreement

Article 3 (Conclusion of Membership Agreement, etc.)

Individuals who wish to join the Cycle Sharing System shall apply to the Corporation for a membership contract by the method specified by the Corporation after agreeing to this agreement. In addition, if the applicant is a minor, the application shall be made after obtaining the consent of a parent or guardian in advance.
A corporation that wishes to join the Cycle Sharing System shall apply for a membership contract to the corporation by the method specified by the corporation with the information necessary to identify the corporate designated user after agreeing to this agreement.
If the Organization accepts the application set forth in the preceding two paragraphs by an individual or corporation who wishes to join the Cycle Sharing System, the membership contract shall be established. In addition, we will announce the details of the type of plan, its contents, precautions, etc. on our designated website. In the event of any changes to these, the Corporation shall announce them on the website designated by the Corporation.
The Corporation shall be able to refuse to conclude a membership contract if the applicant for membership (including the corporate designated user if the applicant is a corporation) falls under any of the following items.
(1) When the height is less than 145 cm.
(2) When the Organization determines that it is physically difficult to safely drive a shared bicycle.
(3) When the payment of fees for past rentals is delinquent.
(4) When it is recognized that the person belongs to an organized crime group, a member of an organized crime group, or other antisocial forces.
(5) If you are under the age of 13 and cannot promise to wear a helmet.
(6) When you do not agree to these Terms.
(7) In addition, when the Corporation deems it inappropriate.
The person who can use the shared bicycle shall be limited to individual members or corporate designated users.

Article 4 (Terms of Use)

In the membership contract, the member shall select one of the plans and payment methods designated by the corporation and make a contract.
The Member shall pay the fees set forth in Chapter 5 according to the plan and payment method contracted pursuant to the preceding two paragraphs.
The location of the port shall be announced on the website designated by the Corporation.

Article 5 (Roaming Service)

The user shall be in a separate area designated by the Corporation outside the jurisdictional area (hereinafter referred to as the "Roaming Area") and shall be subject to the "Privacy Policy of Your Personal Information" separately determined by the Corporation (hereinafter referred to as the "Roaming Area") You may use bicycles provided by a system similar to the cycle sharing system provided by the "Policy" (hereinafter referred to as "Roaming Cooperative Sharing Bicycles") and a place where you can rent, return, and store such bicycles (hereinafter referred to as "Roaming Linked Ports"). However, the Roaming Cooperative Sharing Bicycle can only be used in the roaming area where it was rented, and can only be returned at the Roaming Cooperative Port within the roaming area. In addition, if a shared bicycle rented within the jurisdiction cannot be used or returned in the roaming area, and on the contrary, if the member returns or leaves it in the roaming area, the member shall be liable for all damages incurred by the organization, including the usage fee until it is returned, the cost required for collecting and searching for the bicycle, etc.
When using a roaming linked port or a roaming linked sharing bicycle, the user shall comply with the terms of use of the bicycle sharing system in the roaming area where the bicycle was rented. In this case, regardless of the plan selected by the member in the enrollment agreement, the member shall pay to the corporation the usage fee, etc., calculated based on the one-time member's fee plan (in accordance with the contents of the rate plan separately announced on the website prescribed by the corporation) in the roaming area in accordance with the provisions of Article 28 of this agreement.
Even if the services specified in this article are not available, the Corporation shall not be liable for any damages incurred by the user due to this, and shall not refund the fees for the period during which the services were unavailable.

Article 6 (Change of Registration Information, etc.)

In the event that there is a change in the personal information provided to the Corporation, the contracted plan, or the payment method when applying for a membership contract, the member shall immediately contact the Corporation to that effect and obtain the approval of the Corporation.
If the corporation determines that the content communicated in the preceding paragraph will interfere with the performance of the service, the corporation may refuse this change or cancel the membership agreement.

Article 7 (Cancellation of Membership Agreement)

If the user falls under any of the following items, the corporation shall be able to temporarily suspend the use of the service or cancel the membership contract without any notice or demand.
(1) In the event of a violation of these Terms of Use or any other contract with the Corporation.
(2) When a traffic accident occurs while using a shared bicycle.
(3) When the Member is even once late in paying the fees stipulated in Chapter 5 or other money based on these Terms.
(4) When any of the items of Article 3, Paragraph 4 applies.
(5) In addition to the preceding items, when the Organization determines that it is inappropriate to continue using the cycle sharing system, such as when the Organization and the Member cannot be contacted, or when there is an error in the information at the time of enrollment.

Article 8 (Discontinuation of the Project)

In the event that the Corporation determines that it is difficult to continue the Project due to the unavailability of all or part of the Bicycle Sharing Bicycle or Bicycle Sharing System or other reasons, the Organization may unilaterally suspend the Project.
In the case of the preceding paragraph, the membership agreement will be terminated when the corporation notifies the member to that effect, and the member shall not be required to pay the basic fee after the date of termination of the membership agreement.

Article 9 (Early Termination)

Members shall be able to cancel the membership agreement with the consent of the Corporation. In this case, the member shall pay the basic fee until the date of cancellation of the membership agreement.

Article 10 (Effective Period of Membership Agreement)

The effective period of the Membership Agreement shall be from the date of conclusion of the Membership Agreement to the date of termination of the Project (including successor services equivalent to the Project). However, if the validity period of the enrollment contract is stipulated by the contracted plan, that validity period shall take precedence.

Article 11 (Implementation Period of the Project)

The Corporation shall announce the implementation period of this project on the website prescribed by the Corporation. The implementation period is subject to change without notice due to weather or other operational reasons.

Article 12 (Temporary Suspension, Suspension, and Resumption)

In the event that any of the following items applies, the Corporation may temporarily suspend or suspend the provision of all or part of the cycle sharing system.
(1) When regular or urgent maintenance of equipment for the cycle sharing system is carried out.
(2) When it becomes impossible to provide all or part of the functions due to a failure of the equipment for the cycle sharing system.
(3) When we determine that it is difficult to provide a bicycle sharing system safely due to natural phenomena, local events, or other reasons.
(4) When the Corporation determines that it is necessary to temporarily suspend the equipment for the cycle sharing system for operational or technical reasons.
In the event that the Corporation temporarily suspends or suspends the provision of all or part of the Cycle Sharing System in accordance with the preceding paragraph, the Corporation shall notify the members by a method that the Corporation deems appropriate, such as posting on the website prescribed by the Corporation. However, this does not apply in cases of emergency. The same shall apply to the resumption of the cycle sharing system after the reason for suspension or suspension has been resolved.
Even if part or all of the cycle sharing system is temporarily suspended or suspended due to the reasons set forth in Paragraph 1 of this Article, the Corporation shall not be liable for any damages incurred by the member due to this, and shall not refund the fee for the suspension or suspension period.

Article 13 (Management of IDs, Passwords, etc.)

The user shall appropriately manage the ID and password issued by the Corporation at the time of concluding the membership contract and the unlocking passcode issued by the Organization at the time of lending the shared bicycle at his/her own responsibility, and shall not disclose, leak, or allow a third party to use it.
Except for reasons attributable to the Corporation, the Corporation shall not be liable for the management of the ID, password, and unlocking passcode, and all use of the ID, password, unlocking passcode, and other acts by a third party shall be deemed to be used by the user.
If the ID, password, or unlocking passcode is stolen or misused by a third party, or if there is a risk of such theft, the user must immediately notify the corporation.

Article 14 (Authentication Card)

The user may use the authentication card instead of the unlocking passcode to carry out the rental procedure for the shared bicycle as stipulated in Article 16.
The user shall obtain an authentication card with the functions necessary for registration at his / her own expense and prepare the necessary usage environment.
The user shall use and store the authentication card with the care of a prudent manager, and shall not allow a third party to use it.
All use of the user's authentication card shall be deemed to have been used by the user.
In the event of loss, theft, destruction, or damage to the Authentication Card (hereinafter referred to as "loss, etc."), the User shall promptly notify the Secretariat to that effect.
In the case of the preceding paragraph, regardless of whether or not the loss is due to reasons attributable to the user, the member shall bear an amount equivalent to the actual cost required for the reissuance and registration of the authentication card, and shall pay it to the corporation in accordance with the request of the corporation in the method contracted in Article 4.

Chapter 3 Rental Procedures and Return Procedures

Article 15 (Reservation and Cancellation of Reservation, etc.)

When using a shared bicycle, the user shall clearly indicate in advance the port and bicycle that he or she wishes to rent, and apply for a reservation for an individual rental contract (hereinafter referred to as the "individual contract") by the method prescribed by the Corporation, and the Organization shall respond to this reservation as much as possible in terms of operation, taking into account other reservation conditions and other factors.
Even if the user's reservation is completed in accordance with the preceding paragraph, if the rental procedure stipulated in Article 16, Paragraph 1 is not carried out during the specified period, or if the shared bicycle cannot be rented under the reserved conditions, the corporation shall be able to cancel the reservation unconditionally.
The user shall not make any claim against the corporation regarding the cancellation of the reservation in accordance with the preceding paragraph.

Article 16 (Rental Procedures for Shared Bicycles, etc.)

The rental procedure for a shared bicycle shall be completed when the user who uses the shared bicycle unlocks the shared bicycle by the method prescribed by the Corporation at the port where the available shared bicycle is stored, and the Organization lends the prescribed shared bicycle to the user (hereinafter referred to as the "rental procedure"). In addition, an individual contract shall be established as a result.
Due to the operation of the bicycle sharing system, there are no shared bicycles available at the port, etc., it may not be possible to lend shared bicycles.
The user shall not make any claim (including a claim for refund of basic charges, compensation for the use of alternative means of transportation, etc.) against the Corporation in connection with the inability to use the shared bicycle for the reasons set forth in the preceding paragraph.

Article 17 (Procedures for Returning Shared Bicycles, etc.)

The return procedure for the shared bicycle shall be completed by locking the key provided on the shared bicycle at the port where the shared bicycle can be stored, and by sending a return notice using the attachment operation panel in the manner prescribed by the Organization (hereinafter referred to as the "return procedure"). In addition, the individual contract shall be terminated hereby.
When returning the shared bicycle, the user shall confirm that there are no belongings left on the shared bicycle and return it, and the corporation shall not be liable for any loss of the residual items.
If the user is unable to complete the return procedure pursuant to Paragraph 1 due to reasons such as the lack of a port where the shared bicycle can be stored, the user shall move the shared bicycle to another port where it can be stored and return it.
In the preceding paragraph, in the event of an emergency, such as the user being unable to move to another port, the user shall contact the management office and follow their instructions.
If the user leaves the shared bicycle in a place other than the port without contacting the user in the preceding paragraph or not following the instructions of the management office, it will be deemed that the return procedure has not yet been completed.

Article 18 (Termination of Individual Contracts)

In the event that any of the following items applies, the Corporation shall be able to request the return of the shared bicycle from the user.
(1) When it becomes impossible to continue renting a shared bicycle due to the unavailability of the shared bicycle during the rental time, a malfunction of the bicycle sharing system, or other reasons.
(2) When the user violates this agreement or any other contract with the corporation during the borrowing time.

Chapter 4 Bicycle Accident Treatment, etc.

Article 19 (Accident Handling)

In the event that an accident involving a shared bicycle occurs during the rental time of the shared bicycle, the user shall take legal measures regardless of the scale of the accident and handle it in accordance with the following provisions.
(1) Immediately notify the police and the management office of the accident in charge.
(2) Submit the documents or evidence required by the Corporation and the insurance company designated by the Corporation regarding the accident without delay.
(3) When concluding an out-of-court settlement or agreement with a third party regarding the accident, obtain the consent of the Corporation in advance.
In addition to the preceding paragraph, the user shall handle and resolve the accident at his or her own responsibility and expense.

Article 20 (Measures for Breakdowns, Theft, etc.)

If the user discovers an abnormality or malfunction of the sharing bicycle or port during the rental time, the user shall immediately stop using the bicycle, contact the management office, and follow the instructions of the management office.
In the event that a shared bicycle is stolen during the rental time, the user shall immediately notify the police and the management office in charge of the theft status and follow the instructions of the management office. In addition, the member shall pay the amount specified by the corporation as a burden for the theft of the shared bicycle.

Article 21 (Response when the battery runs out)

When renting a bicycle equipped with a battery such as an electrically power assisted bicycle, if the battery of the shared bicycle runs out of charge or is likely to run out of charge during the rental time of the shared bicycle, the user shall immediately notify the management office regarding the status of the battery loss. In accordance with the instructions of the management office, we will take necessary measures such as returning the shared bicycle to the nearest port.

Article 22 (Indemnity)

Based on the individual contract concluded, the Corporation shall insure various types of non-life insurance as per the following conditions while the user is renting a shared bicycle, etc., and shall compensate the user for damages incurred by the user within the limits of the following items.
(1) Death and permanent disability 10 million yen, hospitalization insurance 5,000 yen per day, outpatient insurance 2,500 yen.
provided, however, that the daily amount of hospitalization insurance is limited to 180 days from the date of the accident, and the daily amount of outpatient insurance is limited to 90 days only for hospital visits within 180 days from the date of the accident.
* The  compensation period is limited to injuries caused by sudden and accidental outpatient accidents.
(2) Liability: Compensation for common personal and property liability: up to 200 million yen
< Special Contract> Litigation Response Fee Up to 10 million yen, Initial Response Fee Up to 10 million yen, Victim Treatment Fee, etc. Up to 500,000 yen per person (30,000 yen for purchase of condolence items)
* The  compensation period is only during the boarding of a shared bicycle. It covers legal liability for damage to the life, body, or property of a third party due to the use of a bicycle.
Any damage that exceeds the compensation limit set forth in the preceding paragraph shall be borne by the member or user.
The Member agrees without objection that damages caused by accidents not reported to the police or the Administrative Secretariat, or accidents caused by members or users violating these Terms of Use, may not be compensated by non-life insurance and the compensation system of the Corporation.
In addition to the preceding two paragraphs, the compensation stipulated in Paragraph 1 may not be applied according to the insurance policy, such as in the case of a disclaimer (failure to pay insurance claims) in the insurance policy of various non-life insurances, and the member or user shall bear all such damages.

Chapter 5 Fees

Article 23 (Fees)

The fee shall mean the registration fee, basic fee, extension fee, and other fees paid by the member to the corporation when the user uses the shared bicycle.
The Corporation shall clearly indicate the amount or calculation basis for each in the fee list and announce it on the website prescribed by the Corporation. In the event of a change in the fee list, the Corporation shall announce it on the website prescribed by the Corporation at least one week prior to the date of the change.

Article 24 (Registration Fee)

The registration fee shall mean the contract fee to be paid when the membership contract is concluded pursuant to Article 3, Paragraphs 1 and 2, the contract option fee to be paid when the member wishes to purchase a dedicated IC card or issue a manual, the change fee to be paid when the contents of the plan are changed, and the renewal fee to be paid at the time of renewal of the membership contract.
In the event that the membership contract is terminated during the contract period due to early termination, cancellation, or other reasons, the member agrees without objection that the registration fee received by the corporation pursuant to the preceding paragraph will not be refunded, except in cases where the contract is terminated due to reasons attributable to the corporation.

Article 25 (Basic Charges)

The basic fee shall mean the basic fee to be paid according to the period of receiving the service specified by each plan, such as month or day, hour, etc., in accordance with the plan contracted under Article 4, Paragraph 1, re-registered under Paragraph 2, or changed in accordance with Article 6, Paragraph 1.

Article 26 (Extension Fee)

The extension fee shall mean the extension fee paid when the user uses the shared bicycle beyond the initial usage time specified in each shared bicycle plan rented by the user.
The extension fee shall be charged for the period from the expiration of the initial usage time set forth in the preceding paragraph until the user completes the refund procedure set forth in Article 17.

Article 27 (Other Charges)

Other fees shall mean registration fees, basic fees, extension fees, and other fees to be paid for paid services announced by the Corporation and requested by the Member or the Corporate Designated User.

Article 28 (Payment of Fees)

The Member shall pay the total amount of the fees for the month in which the Service was provided to the Corporation on the payment date designated by the Corporation in the following month by the payment method that the Member contracted under Article 4, Paragraph 1, re-registered under Paragraph 2, or changed in accordance with the plan changed in accordance with Article 6, Paragraph 1.
In the event that the Corporation is unable to receive payment from the Member by the means set forth in the preceding paragraph, the Corporation shall be able to receive payment by other payment methods specified by the Corporation.

Chapter 6 Responsibilities

Article 29 (Periodic Inspection and Maintenance)

We will carry out periodic inspections and maintenance of shared bicycles and ports in accordance with the standards set by our organization.

Article 30 (Pre-Use Inspection)

Each time the user rents a shared bicycle, the user shall confirm that the braking effect, the bending of the handlebars, the tire pressure, the ringing of the bell, the attachment control panel, the remaining battery level, etc. are in a safe and appropriate condition.
In the event that the user discovers any damage, loss of equipment, or poor maintenance of the shared bicycle, the user shall immediately contact the management office and stop using it.
If you use a shared bicycle without contacting us as described in the preceding paragraph, it will be deemed that there was no damage, loss of equipment, or poor maintenance of the shared bicycle at the time of borrowing.

Article 31 (Management Responsibility)

The user shall use and store the shared bicycle with the care of a good manager.
The management responsibility set forth in the preceding paragraph shall begin when the rental procedure for the shared bicycle based on the individual contract is completed, and shall end when the procedure for returning the bicycle is completed.

Article 32 (Prohibited Acts)

The user shall not engage in the following acts.
(1) Allow someone other than the user to use the shared bicycle.
(2) Dangerous acts such as reckless driving and driving under the influence of alcohol.
(3) Use of shared bicycles in disregard of traffic rules.
(4) Use in parks, dangerous areas, or inappropriate places where entry is prohibited.
(5) Acts that obstruct the passage of pedestrians, etc.
(6) Modification, removal or modification of the structure, equipment, accessories, etc. of the bicycle.
(7) Parking bicycles in areas where bicycles are prohibited from being left as stipulated by ordinances, on private land where permission cannot be obtained, and in places that may obstruct traffic.
(8) The act of transporting a bicycle by vehicle, etc., and using the bicycle at the transportation destination. (Transportation is prohibited both inside and outside Kanazawa city.) However, this does not apply when using services provided by public transportation such as cycle trains. )
(9) In the event of a breakdown during operation, the act of forcibly continuing driving.
(10) Using a shared bicycle for various tests, competitions, towing, or boosting.
(11) Occupying a shared bicycle for a long period of time beyond its original purpose of use (e.g., detaining a bicycle at home or office in anticipation of its use the next day).
(12) If you are under the age of 13, do not wear a helmet.
(13) The process of automatically collecting information from websites using computer software technology such as web scraping, web crawler, web spider, etc., regardless of the name of the bicycle sharing system or the website prescribed by the Corporation. Any other act that may place an excessive load on the system or interfere with the stable provision of services.
(14) Other acts that violate laws and regulations or public order and morals.

Article 33 (Violation of the Road Traffic Act, etc., and Measures for Abandoned Bicycles)

In the event that the user violates the provisions of the Road Traffic Act with respect to the shared bicycle while using the shared bicycle, the user shall be responsible for all the violations, including the payment of fines related to the violation.
When a user parks a shared bicycle in a place prohibited by Item 7 of the preceding Article (hereinafter referred to as "abandonment"), the user shall be responsible for compensating for various expenses such as removal and storage of the abandoned bicycle, usage fees until it is returned, and any other damages incurred by the organization.
In the case of the preceding paragraph, if the local government or the police contact the corporation about the abandonment of the bicycle, the corporation shall contact the user, promptly move the shared bicycle to the place designated by the corporation, and request that the violator comply with the legal measures, and the user shall comply with this.
In the event that the Organization pays the expenses set forth in Paragraph 2 in advance, the Member shall promptly pay such expenses to the Corporation.

Article 34 (Obligation to Return Shared Bicycles)

When returning the Shared Bicycle, the User shall return it in the condition in which it was borrowed, excluding wear and tear due to normal use, and if all or part of the Shared Bicycle, including equipment, is damaged, lost, stolen, etc., due to reasons attributable to the User, the Member shall bear all expenses required for restoring the Shared Bicycle to its original condition, including repair and replacement costs.

Article 35 (Measures to be taken if the shared bicycle is not returned)

In the event that the user does not return the shared bicycle even after exceeding the available time specified in each plan and does not respond to the request for the return of the bicycle, or if the corporation determines that the shared bicycle has been ridden away due to circumstances such as the user's whereabouts are unknown, the corporation may cancel the membership contract and take legal measures such as filing a criminal complaint.
In the event that any of the preceding paragraphs apply, the member shall be liable for all damages incurred by the organization, including the usage fee until it is returned, the cost required for collecting and searching for the shared bicycle, etc.
In the event that the sharing bicycle is not returned by the user even after the cycle sharing system is available due to natural disasters or other force majeure reasons, the corporation shall not be liable for the damage caused by this. In this case, the user shall immediately contact the management office and follow its instructions.

Article 36 (Liability)

In addition to the provisions of this agreement, the member shall be responsible for compensating for the damage caused to a third party or the corporation by using the shared bicycle. However, this does not apply to reasons not attributable to the user.

Chapter 7 Disclaimer

Article 37 (Disclaimer)

Regardless of the reason, even if the user suffers damage due to the use of the shared bicycle or the inability to use the shared bicycle, the user shall not be able to claim compensation for damages beyond the amount of money received from the member as consideration for the use of the shared bicycle, except in cases of willful misconduct or gross negligence on the part of the organization. In addition, the scope of damages to be compensated shall be limited to ordinary damages incurred by the user, except in cases of willful misconduct or gross negligence on the part of the Corporation, and the Corporation shall not be liable for compensation for special damages, including lost profits, regardless of whether or not such damages are foreseeable.

Chapter 8 Use of Customer Information

Article 38 (Use of Customer Information)

The Corporation will handle the personal information of members (information that can identify the member himself / herself by such information or by collating with other information) obtained in the course of providing services in accordance with the "Privacy Policy on Customers' Personal Information" separately established by the Corporation and this agreement.
We may provide the personal information of members to the following third parties.

The joint use of members' personal information will also be handled in accordance with the "Privacy Policy for Customers' Personal Information" separately established by the Corporation and this agreement.

Chapter 9 Miscellaneous

Article 39 (Modification of the Terms)

If we revise this agreement, we will notify you by posting it on our designated website. In addition, revisions to this agreement may be made without prior notice to the user.

Article 40 (Notice, etc.)

Notices and communications from the Organization to Members shall be made to the telephone number or e-mail address registered with the Corporation, and the notification and communication shall take effect at the time of transmission, and the Member shall bear the disadvantage of non-delivery.

Article 41 (Late Charges)

In the event that a member fails to perform any financial obligations based on these Terms, the Membership Agreement, or an individual contract, the Member shall pay the Organization a late payment fee at the rate of 14.6% per annum (calculated on a pro-rata basis with one year being 365 days).

Article 42 (Court of Jurisdiction)

In the event of a dispute regarding the rights and obligations under this agreement, the membership agreement or individual agreement, the Izumo Summary Court shall be the exclusive jurisdictional court.

Article 43 (Consumption Tax)

Members shall pay consumption tax (including local consumption tax) levied on monetary obligations under these Terms and Conditions.
